Al-Saddah says Nazaha preparing project to criminalize bribery, conflicts of interest

Lulwa Al-Saddah senior legal specialist at the Public Authority for Anti-Corruption (Nazaha) said the study of legislation and legal tools falls within the jurisdiction of the authority and cited Article (5) of Law No. 2/2016 establishing the Authority, as well as Article No. (4) of the same law, which stipulates that “the commission works to implement the provisions of the United Nations Convention against Corruption approved by Law No. 47 of 2006 and international agreements and treaties related to combating corruption.”

Al-Saddah told a local Arabic daily that from this pointy of view the authority worked during the previous period with the concerned authorities — Department of Fatwa and Legislation and the Ministry of Justice to prepare 4 draft laws, and among these the Law No. 12 of 2020 regarding the right to access was approved.

A draft law on amending the provisions of the Kuwaiti Penal Code with regard to punish bribery in the private sector and extending criminal responsibility to include legal persons in corruption crimes, and a draft law on preventing conflicts of interest, after the issuance of the Constitutional Court ruling to invalidate the conflict of interest Law No. 13 of 2018.

Al-Saddah indicated that the commission worked on preparing this project so that there would be no legislative vacuum in this field, pointing out that these projects were approved by the Council of Ministers and referred to the National Assembly to be approved in accordance with constitutional rules.

The sources stated that the authority aims, through the approval of these legislations and laws, to implement the international obligations to which Kuwait is a party, and also as Kuwait is a member state of the United Nations and a signatory to the United Nations Convention against Corruption.

She pointed out that the approval of these laws also contributes to strengthening the principle of Transparency and Integrity in economic and administrative transactions in the country with the aim of avoiding international observations that were previously addressed to Kuwait while it was subject to international review in accordance with the review mechanism, which applies to all member states of the United Nations Convention against Corruption, which will reflect positively on the Corruption Perceptions Index.
