MOC ordered to pay 1 Million dinars temporary compensation

The Court of Cassation ordered the Ministry of Commerce and Industry and others jointly to pay one million dinars temporary compensation after the Ministry lost a case filed against it in 2012 regarding the appropriation and use of a trademark and offering it for sale to another party.

Informed sources told a local Arabic daily the Ministry of Commerce lost a ruling by the Court of Appeal in 2017 regarding a complaint submitted by a trademark owner indicating that his trademark registered with Al-Tijara was exploited by another unworthy party, although the Ministry won the case at a first ruling.

The sources indicated that the Department of Experts summoned the “Ministry of Commerce” 3 times, but the ministry did not appear, and did not present its defense before the “experts”, which resulted in the issuance of the expert’s report against the ministry and the Court of Cassation upheld the verdict of the Appeal Court to pay temporary compensation to the plaintiff to seek final compensation against the ministry.

It is likely that the Ministry of Commerce will open an investigation to find out the procedural and legal shortcomings, to determine the cause of the shortcomings that led to the issuance of the ruling against the ministry.
